  • Original HR letter addressed to CAE dated, stamped, and authenticated at the country of work’s of Chamber of Commerce and the Egyptian embassy. Must also be authenticated from the Egyptian Foreign Ministry

Unit Documents

 

First: Units Registered at the Real Estate Declaration Authority

1.Ownership Documents for Preparing the Legal Memo Addressed to the Department Presenting the Documents (Branch, Sales, Financing Department):

  • A copy of the contract registered in the name of the owner at the Real Estate Registration Authority
  • A copy of a valid ID or passport of both the seller and the Bank’s customer (the Customer)
  • A phone number of both the seller and the Bank’s customer

2. Ownership Documents to Be Provided Later but prior to the Legal Department’s Revision

  • Original certificate of a digital survey for the financed unit with global coordinate system (WGS 84 form)
  • A certificate of real estate ownership transfer for and by the seller (Form 19) – Available at the Real Estate Registration Authority in whose jurisdiction the property is situated – Dates as from the date of the registered contract – The Customer has to bring it and revised by Legal Department – This is in order to verify that the property is in the seller’s name and has not sold or mortgaged it.

3.Upon Executing the Booking Procedures

  • Both the seller and the customer have to sign the tri-partite agreement.
  • Both the seller and the customer have to issue powers of attorneys in favor of the Bank.
  • Both the seller and the Customer have to issue powers of attorneys in favor of the external lawyer in order to allow the lawyers to transfer the ownership in the customer’s name.
  • Signed consolidated undertaking by client.

4. After booking, Legal Department shall be in charge of the following:

  • Date certification of the tripartite agreement before notary public office.
  • Registration of the real estate mortgage in the Bank’s name.

 

Second: Where the Unit is in a Separate Plot on Allocated Land in the New Cities:

1.Ownership Documents for Preparing the Legal Memo Addressed to the Department Presenting the Documents (Branch, Sales, Financing Department):

  • A copy of the preliminary contract of the land or a copy of the of the resolution allocating the land where the unit is situated in the name of the seller (the landowner) issued by the New Urban Communities Authority
  • A copy of a valid ID or passport of both the seller and the Customer
  • A phone number of both the seller and the Bank’s customer
  • A copy of the construction permits

2. Ownership Documents That Can Be Completed Later but Prior to Payment of Finance and Legal Department’s Revision.

  • A letter from the New Urban Communities Authority – Presented by the seller that a mortgage can be executed – Presented prior to payment of financing in accordance with minister of housing decree no. 100 of 2014 or the seller’s temporary guarantee transfer in favor of the bank in accordance with minister of housing decree no. 146 of 2021

3.Upon Executing the Booking procedures

  • Both the seller and the Customer have to sign the tri-partite agreement
  • Both the seller and the Customer have to issue powers of attorneys in favor of the Bank
  • A consolidate report of the facility and the unit signed by the client
  • A certificate of waiver from the seller’s temporary guarantee transfer in favor of the bank in accordance with Minister Of Housing Decree no. 146 of 2021 or to the effect that a mortgage can be executed in accordance with Minister Of Housing Decree no. 100 of 2014 upon the completion of financing procedures

 

Third: Units Inside a Compound Approved by CAE in NUCA or Tourism Development Authority or Governorate:

1. Ownership documents for preparing the legal memo addressed to the department presenting the documents (branch, sales, financing department):

  • A copy of a valid ID or passport of both the seller and the Customer
  • A phone number of both the seller and the Bank’s customer
  • The preliminary contract issued by the authority/tourism development authority/governorate

2. Ownership Documents That Can Be Completed Later but Prior to Payment of finance and Legal Department’s Revision

  • A letter from the New Urban Communities Authority – Presented by the seller that a mortgage can be executed – Presented prior to payment of financing in accordance with minister of housing decree no. 100 of 2014 or the seller’s temporary guarantee transfer in favor of the bank in accordance with minister of housing decree no. 146 of 2021 or The seller’s waiver of the unit subject to the financing request in favor of the bank, certified by the local unit in accordance with the Minister of Local Development’s Decision No. 19 of 2022, or the issuance of a letter from the governorate and the notarization of the waiver at the real estate registry, with the restriction included in the notarized declaration

3.Upon Executing the Booking Procedures:

  • Both the seller and the Customer have to sign the tri-partite agreement
  • Both the seller and the Customer have to issue powers of attorneys in favor of the Bank
  • Signed consolidated undertaking by client
  • A certificate of waiver from the seller’s temporary guarantee transfer in favor of the bank in accordance with minister of housing decree no. 146 of 2021 or to the effect that a mortgage can be executed in accordance with minister of housing decree no. 100 of 2014 upon the completion of financing procedures

 

Fourth: Units inside a compound approved by CAE

1. Ownership Documents for Preparing the Legal Memo Addressed to the Department Presenting the Documents (Branch, Sales, Financing Department):

  • A copy of a valid ID or passport of both the seller and the Customer
  • A phone number of both the seller and the Bank’s customer
  • The preliminary contract of sale between the compound and the seller– to be provided by either the seller or the customer

2. Ownership Documents that can be completed later but prior to booking of finance and Legal Department’s revision.

  • A phone number of both the seller and the Bank’s customer

3.Upon executing the booking procedures

  • Both the seller and the Customer have to sign the tri-partite agreement
  • Both the seller and the Customer have to issue powers of attorneys in favor of the Bank
  • Signed consolidated undertaking by client
  • An assignment/transfer of ownership must be signed by the seller in favor of the Customer. This should be signed at the company that owns the project, and the company must approve this transfer
  • Upon booking, the Bank must be provided with an original copy of a letter prohibiting any further sales in favor of the Bank

 

Fifth: Units Inside a Compound Non-Approved by CAE:

1. The Project’s Documents

  • The preliminary contract of sale concerning the land, issued by the Authority
  • The Ministerial Decree approving the land planning and plans
  • A recent financial status concerning the land
  • A copy of the construction permits

2. The company’s documents:

  • A recent extract of the company’s commercial register (issued within last 3 months)
  • A copy of Tax Card
  • A copy of Article of association and its amendments.
  • A certificate of real estate ownership transfers for and by the seller (Form 19) – issued by the main Real Estate Registration Authority in whose jurisdiction the property is situated – based on the date of registered contract (issued by the bank processing takes between 15 to 20 days)

3. The unit’s documents:

  • A copy of the preliminary sale of unit contract
  • A copy of a valid ID or passport of both the seller and the Customer
  • The unit’s financial position issued by the owner of the real estate developer or the owners’ association – To include financial obligations attached to the unit

4.Upon Executing the booking procedures

  • Both the seller and the Customer have to sign the tri-partite agreement.
  • Both the seller and the Customer have to issue powers of attorneys in favor of the Bank
  • Signed consolidated undertaking by client
  • An assignment/transfer of ownership to be signed by the seller in favor of the Customer – To be signed at the company that owns the project and the company must approve this transfer
  • Upon booking, the Bank must be provided with an original copy of a letter prohibiting any further sales in favor of the Bank
